Terms of Service

These Terms of Service ("Terms") govern your access to and use of ARIA, an AI companion platform operated at aria-ai.online (the "Service"), operated by ARIA ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

By using the Service, you represent that you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and that creating an account and accessing this content is legal in your jurisdiction of residence.

2. Nature of the Service

ARIA lets you create and interact with AI-generated companion characters, including text conversation, generated images, and generated video. All characters, dialogue, images, and video produced through the Service are entirely fictional and AI-generated. They do not depict real people, do not represent factual information, and should not be relied upon as such.

3. Account Registration

• You must provide a real, working email address to register (disposable/temporary email addresses are not permitted)
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• One account per person. Creating multiple accounts to abuse free-trial credits or promotions is prohibited

4. Acceptable Use

You agree not to use the Service to generate, upload, or request content that:

• Depicts, references, or sexualizes minors in any way, under any framing
• Depicts a real, identifiable person without their consent, including through face-swapping or likeness-based prompts
• Is intended to harass, threaten, defame, or harm any individual or group
• Violates any applicable law, including obscenity laws in your jurisdiction
• Infringes on the intellectual property rights of others
• Attempts to circumvent, exploit, or abuse the Service's billing, rate-limiting, or access-control systems
• Involves scripted, automated, or bot-driven account creation or usage

We reserve the right to suspend or terminate any account, without refund, that violates this section, and to report unlawful content (including any content involving the sexualization of minors) to appropriate authorities.

5. Credits, Billing, and Payments

• New accounts receive a one-time free-trial credit balance, subject to email verification
• Additional credit is purchased via cryptocurrency top-up through our payment processor, NOWPayments
• Credit balances are consumed as you generate images and video; pricing per generation is shown in-app and may change over time
• All payments are final. Because payments are processed via cryptocurrency and credit is consumed immediately upon use, purchases are generally non-refundable, except where required by law or at our sole discretion
• Unused credit balances do not expire but hold no cash value and are non-transferable
• We are not responsible for cryptocurrency price volatility, network fees, or misdirected payments sent to an incorrect address

6. Intellectual Property

As between you and us, you retain ownership of the text prompts you write. Subject to your compliance with these Terms, we grant you a license to use content generated for you through the Service for personal, non-commercial purposes. We do not claim ownership over your generated content, but you grant us a limited license to store, process, and display it back to you as part of operating the Service.

You are solely responsible for ensuring your use of generated content complies with applicable law in your jurisdiction, including any restrictions on AI-generated or adult-oriented material.

7. Service Availability and AI Limitations

ARIA is an experimental platform built on third-party AI models. We do not guarantee uninterrupted availability, and generated content may be inaccurate, inconsistent, or occasionally fail to generate. The Service is provided on an "as is" and "as available" basis.

8. Termination

We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, suspected fraud or abuse, or at our discretion. You may stop using the Service and request account deletion at any time by contacting us.

9. Limitation of Liability

To the maximum extent permitted by law, ARIA and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the [3 months / other period] preceding the claim.

10. Disclaimer of Warranties

The Service is provided without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.

12. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above when changes are made. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
